Midwifery Under Fire in PA

As midwifery in this country continues to be challenged, we as co-advocates for natural birthing need to consider lending our support. In PA, for example, a CPM is being charged with involuntary manslaughter, endangering the life of a minor and practicing midwifery without a license. (http://www.friendsofjudy.org)

The charges against Wilson stem from the 2002 birth of Isaac Daley, who was born at home but died two days later after being transported to the hospital. The infant’s parents, Heather and Jon Daley, do not support the charges against Wilson and have joined thousands of other families in Pennsylvania and throughout the country in signing a petition protesting the District Attorney’s attempts to use the court system to regulate healthcare professionals.

The District Attorney, who has brought the charges, recently announced that he is contemplating calling a Grand Jury to look into ALL UNLICENSED MIDWIVES in PA. http://www.pittsburghlive.com/x/tribune-review/news/s_191451.html His quote was: "It's obvious from this that a number of people doing this are not licensed," Zappala said about lay midwives, although he didn't know exact numbers. "I think we need to look at the statutes involved because if you're going to have a statute, then you need to enforce it."

PA only licenses CNMs who work under OBs in a hospital setting. There is no licensure recognized for homebirth midwives, therefore they can NOT be licensed. According to The Midwives Alliance of North America (MANA), Midwifery is legal in Pennsylvania by Judicial Interpretation or Statutory Inference.
